It is clear that Eartia uses the Marks of vendors and respective third parties procured from the owner and/or concerned channel. In this process Eartia has no intention, whatsoever, to acquire rights of license to these Marks.

This Infringement/copyright policy helps in creating a user-friendly marketplace by prohibiting the use of Eartia for infringing the IP (intellectual property) rights of third parties.

Eartia policy requires buyers, sellers and/or users to comply with all govt. laws and regulations including but not limited to the copyright policy as stated from time to time.

Eartia will not be able to process requests which do not specify exact URLs or IDs and the details given below. Please do not send links to any dynamic pages whose content change time to time, this will create ambiguity and Eartia will not process this type of requests.

How to report an Infringement

If you strongly believe that your intellectual property right has been infringed by any means on Eartia’s website, you may follow the below steps to seek help.

We need an email from the IP right owner or authorized person to the aforementioned email id with the below details.

The email must have following details

  1. Proper and specific Identification or details of the Intellectual Property Rights that has been infringed.
  2. Clear identification or details of location of the material that you claim is infringing is located on Eartia site with full details. Listing or Product ID or website urls/links of infringing products.
  3. Your mailing address, phone number and an active email address.
  4. A statement by the IP owner or authorized person(you), that the information provided in your report is accurate and that you are the IP owner or authorized person to act on behalf of the copyright or IP owner.
  5. Brand Name or Trade Name or Logo Name (in case of Trademark infringement)
  6. Full Details of the IP (intellectual property) being infringed (Must provide copyrighted materials such as trademark, images, etc as attachments)
  7. Full details of legal proceedings initiated against the organization/person.

Grievance Redressal:

Eartia shall take all necessary and important steps to remove the infringed product or listing details from its web portal within 16 (Fifteen) working days subject to verification of the complaint given above.
